Welcome to stellahuvaes Ltd ("Company", "we", "our", or "us"). These Terms of Service ("Terms") govern your use of our website located at stellahuvaes.top and our fitness programme completion analytics dashboard services (collectively, the "Service") operated by stellahuvaes Ltd, a company registered in Malta with registration number C63258.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service. Your acceptance of these Terms creates a legally binding agreement between you and stellahuvaes Ltd.

Description of Service

stellahuvaes provides fitness programme completion analytics dashboard services designed to help fitness centres, gyms, and related businesses track, analyse, and optimise their fitness programme completion rates and member engagement metrics.

Our Service includes but is not limited to: custom analytics dashboards, performance tracking systems, member engagement analytics, reporting tools, consultation services, and related technical support.

User Obligations

As a user of our Service, you agree to comply with all applicable laws and regulations and to use the Service only for lawful purposes. You are responsible for ensuring that your use of the Service does not violate any applicable laws or regulations in your jurisdiction.

You agree not to use the Service:

In no event shall stellahuvaes Ltd's total liability to you for all damages, losses, and causes of action exceed the amount you have paid to stellahuvaes Ltd in the twelve (12) months prior to the incident giving rise to liability, or one hundred euros (€100), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you. In such jurisdictions, our liability will be limited to the fullest extent permitted by law.

These Terms shall be interpreted and governed by the laws of Malta, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of Malta, and you hereby consent to personal jurisdiction and venue therein.

If you are a consumer resident in the European Union, you also have the right to bring proceedings in the courts of your country of residence, and these Terms will not deprive you of the protection of the mandatory provisions of consumer protection laws in your country.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service and contact us to request account deletion.

Upon termination, your right to use the Service will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
